By accessing or using the Service, you agree to the practices described in this Policy.
This Privacy Policy should be read in conjunction with our Terms of Service, which govern your use of the Service and include important provisions regarding data access and usage rights.
1. Information We Collect
We collect the following categories of information in connection with the Service:
1.1 Account Information
When you register for an account, we collect information necessary to establish and maintain your account, including:
- Full name, email address, and phone number
- Business name, address, and industry
- Payment and billing information (processed through third-party payment processors)
- Account credentials and authentication data
1.2 Call Data
We collect comprehensive data from all calls processed through the Service, including:
- Full call transcripts — complete text records of all conversations between AI agents and end callers
- Audio recordings — full audio recordings of calls where recording is enabled
- Call metadata — call duration, timestamps, originating and receiving phone numbers, caller identification data, geographic information, call disposition, and call outcome classifications
- Conversation analytics — sentiment analysis, topic classification, intent detection, and other AI-derived insights from call content
1.3 AI Agent Configuration Data
- Agent prompts, instructions, and system configurations
- Custom knowledge bases and reference materials uploaded by Users
- Voice settings, personality configurations, and behavioral parameters
- Workflow definitions, routing rules, and automation logic
1.4 Usage & Technical Data
- Platform usage patterns, feature utilization, and interaction logs
- Device information, browser type, operating system, and IP address
- Performance metrics, error logs, and diagnostic data
- Cookies, session data, and similar tracking technologies
1.5 Integration Data
- Data exchanged between the Service and connected third-party platforms (CRMs, calendars, email systems, etc.)
- API request and response data
- Authentication tokens and integration configuration data
2. How We Use Your Data
We use the data we collect for the following purposes. By using the Service, you expressly consent to all uses described below.
2.1 Service Operations
- Providing, operating, and maintaining the Service and all its features
- Processing and facilitating AI agent calls and conversations
- Managing your account, processing payments, and communicating with you about the Service
2.2 Quality Assurance & Monitoring
- Reviewing and analyzing call transcripts and audio recordings to monitor service quality, identify issues, and ensure platform reliability
- Evaluating AI agent performance and response accuracy
- Investigating complaints, errors, and service disruptions
2.3 AI Development & Product Improvement
- Training, fine-tuning, and improving AI models using call transcripts, recordings, and conversation data
- Developing new features, capabilities, and service enhancements
- Optimizing natural language processing, speech recognition, and voice synthesis
- Benchmarking and evaluating AI performance across use cases
2.4 Analytics & Business Intelligence
- Generating usage reports, analytics dashboards, and performance metrics for Users
- Producing aggregated industry insights and benchmarking data
- Conducting internal research and analysis to improve our business operations
2.5 Security & Compliance
- Detecting, preventing, and responding to security threats, fraud, and abuse
- Enforcing our Terms of Service and Acceptable Use Policy
- Complying with applicable legal obligations, court orders, and regulatory requirements
3. Data Sharing & Disclosure
We may share your information with the following categories of recipients:
3.1 Service Providers & Infrastructure Partners
We engage third-party companies to provide essential infrastructure and services that enable the operation of the platform, including:
- Cloud hosting and data storage providers
- Telephony and telecommunications providers
- AI model providers and speech processing services
- Payment processors
- Analytics and monitoring services
These service providers are contractually obligated to use your data only for the purposes of providing services to Terminus and are required to maintain the confidentiality and security of your data.
3.2 Legal Requirements
We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to: (a) comply with a legal obligation, subpoena, court order, or governmental request; (b) protect and defend the rights or property of Terminus; (c) prevent or investigate possible wrongdoing in connection with the Service; or (d) protect the personal safety of users or the public.
3.3 Business Transfers
In the event that Terminus is involved in a merger, acquisition, reorganization, bankruptcy, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.
3.4 SMS Campaign Data
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
3.5 Aggregated & Anonymized Data
We may share aggregated and anonymized data that cannot reasonably be used to identify you or any individual end caller with third parties for any purpose, including research, marketing, analytics, and industry reporting.
4. Data Retention
We retain your data for as long as reasonably necessary to fulfill the purposes described in this Policy, subject to the following guidelines:
- Account data is retained for the duration of your active account and for a period of up to twelve (12) months after account termination.
- Call transcripts and recordings are retained for a minimum of twelve (12) months from the date of the call and may be retained for longer periods as needed for AI model training, service improvement, or compliance purposes.
- Anonymized and aggregated data derived from your usage may be retained indefinitely, as it cannot be used to identify any individual.
- Payment data is retained in accordance with applicable financial record-keeping requirements.
Upon account termination, you may request deletion of your identifiable data, subject to our legal obligations and the data usage rights described in the Terms of Service. Please note that data already incorporated into anonymized datasets, trained AI models, or aggregated analytics cannot be individually extracted or deleted.
5. Your Rights
Depending on your jurisdiction, you may have the following rights with respect to your personal information:
5.1 Access & Portability
You may request a copy of the personal information we hold about you. We will provide this information in a commonly used, machine-readable format where technically feasible.
5.2 Correction
You may request correction of inaccurate or incomplete personal information in your account.
5.3 Deletion
You may request deletion of your personal information, subject to certain limitations. Please note that deletion requests may be limited by our data usage rights under the Terms of Service, our legal obligations, and the practical impossibility of removing data that has already been incorporated into trained AI models or anonymized datasets. We will inform you if we are unable to fully comply with a deletion request and explain the reasons.
5.4 Opt-Out of Sale / Sharing
If applicable under your local law (such as the California Consumer Privacy Act), you may opt out of the sale or sharing of your personal information. To exercise this right, please contact us using the information provided in Section 10.
5.5 How to Exercise Your Rights
To exercise any of the rights described above, please submit a request to zach@tryterminus.com. We will respond to verified requests within the timeframes required by applicable law (typically thirty (30) to forty-five (45) days). We may request additional information to verify your identity before processing your request.
6. Third-Party Services
The Service relies on third-party technology providers for essential functionality. While we do not disclose the specific identities of all providers (which may change over time), the categories of third-party services involved in processing your data include:
- AI language model providers (for natural language understanding and response generation)
- Speech-to-text and text-to-speech service providers
- Telephony and SIP trunking providers
- Real-time communication infrastructure providers
- Cloud hosting and data storage services
- Payment processing services
Each of these providers operates under their own privacy policies and data processing agreements. Terminus requires all third-party providers to maintain appropriate security standards and limit their use of data to the services they provide to us.

No method of electronic transmission or storage is 100% secure. While we strive to use commercially reasonable means to protect your data, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.
8. Children's Privacy
The Service is not intended for use by individuals under the age of eighteen (18). We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly. The Service is operated from the United States. If you are accessing the Service from outside the United States, please be aware that your data may be transferred to, stored, and processed in the United States and other countries where our service providers operate.
